1 Scott Frohmader appeals from a judgment finding him guilty of operating a motor vehicle while under the influence of an intoxicant (third offense) as well as operating with a prohibited alcohol concentration (third offense). Frohmader believes the trial court erred in its instructions given to the jury because the instructions misled the jury. We disagree and therefore affirm the judgment of the trial court.
