Defendant-Appellant/Cross-Appellee Raita Fukusaku (Defendant) appeals his convictions and sentences on two counts of murder in the second degree, in violation of Hawai'i Revised Statutes (HRS) § 707-701.5 (1993).*fn1 Plaintiff-Appellee/Cross-Appellant State of Hawai'i (the Prosecution) cross-appeals various orders of the circuit court entered in the course of the proceedings. Pursuant to the procedure established in Garringer v. State, 80 Haw. 327, 909 P.2d 1142 (1996), we will withhold judgment on Defendant's convictions for thirty days. If the Prosecution, within that time, consents to resentencing without mandatory minimum terms under HRS § 706-660.1, we will affirm the convictions and remand for resentencing. If, on the other hand, the Prosecution does not  consent, we will vacate the convictions and remand for retrial.
